Event Ticket Terms and Conditions
The Cat Protection Society | Event Terms and Conditions
- This agreement is between The Cat Protection Society of NSW Limited (ABN 81 610 951 615) trading as the Cat Protection Society (‘We’, ‘Us’ ‘Our’) and you, the person purchasing a ticket (‘You’, ‘Your’) to Our Event, Great Writers and the Cats who Owned Them: An Evening with Susannah Fullerton being held at the Dendy Cinema Newtown (‘the Venue’), (‘the Event’).
- This agreement will start when You accept it and will continue until the parties have discharged their obligations under this agreement, unless or until terminated earlier in accordance with these terms.
- By proceeding to purchase a ticket to the Event, You’re telling Us that You’ve read, understood and accepted these terms.
- If You are purchasing a ticket on behalf of an individual aged less than 18 years old, You agree to these terms on their behalf.
- Please make sure You take a moment to carefully read these terms and conditions as, once accepted, they can only be waived or changed if agreed in writing.
Placing an Order
- Please note that when You submit an order through the website no agreement is formed until we process and accept Your order and send You a confirmation.
- You agree to pay Us the ticket price listed at the time of purchase. Applicable third-party processing fees may apply.
- Prices are in Australian Dollars (AUD) and inclusive of GST unless otherwise stated.
- Tickets can be purchased through Our website, which will direct You to a third-party platform, Raisely.
- In making a payment, You warrant to Us that You’ve read and agreed to the terms of any third-party payment gateway or processor (such as Raisley), which are available on their respective websites.
- You understand that these services are provided by third parties and are made available to You on Our website for convenience only.
- We’re not responsible for any issues, loss or damage arising out of those facilities. If You have an issue with a third-party provider on Our website, please contact them directly.
- If a request for payment is returned or denied by Your financial institution or is unpaid by You for any other reason, then You’ll be liable for any associated costs incurred by Us, including banking fees and charges.
Tickets
- Tickets are for general admission and admit one person only.
- There is no reserved or allocated seating available.
- Your ticket includes entry to the Event and the provision of light refreshments.
- Tickets are only valid if they are purchased through our website via Raisley.
- Tickets cannot be resold or transferred to another person without Our written permission.
Venue and Attendance
- Entry to this Event is subject to the conditions of entry of the Venue.
- Children may only attend the Event in the presence of an adult guardian who must accompany them at all times.
- We or the Venue operator may refuse You entry if You fail to comply with these terms and conditions or the terms and conditions of the Venue.
- Entry to the Venue and attendance at the Event is at Your own risk. You are responsible for Your own well-being and property during attendance.
Discounts
- We offer tickets to Our Event at a discounted rate for Our members.
- You are only permitted to purchase a ticket at a discounted rate if You hold a valid membership with Us.
- One membership entitles You to one discounted ticket only.
- We reserve the right to cancel Your order and refund You the amount paid if You have purchased a ticket at the incorrect rate.
- Please ensure that You carefully select the correct ticket type as You will only be entitled to a refund for the ticket fee, not third-party and handling fees if You make a mistake.
Donations and Deductible Gifts
- Purchasing a ticket to attend our Event is not a charitable donation and is not eligible as a deductible gift.
- However, as part of the checkout process, Raisely will provide You with the opportunity to make a donation to the Cat Protection Society.
- Making a donation is entirely voluntary, is not required to place and order and does not form part of Your order.
- In the Event that we are required to refund Your order, any donation that You make is independent from the order and will not be refunded.
Refunds
- We offer refunds in accordance with Our obligations under the Australian Consumer Law (ACL).
- Please be aware that we do not provide refunds for change of mind.
- If You are unable to attend a live Event due to illness or emergency, please contact Us as soon as possible. At Our discretion, we may offer a refund where it is reasonable and feasible.
Changes, Rescheduling, and Cancellation
- We may cancel, reschedule or make material changes to Our Event due to circumstances outside Our control (including insufficient registrations, presenter illness, Venue unavailability or unforeseen events).
- If we cancel an Event, a full refund will be processed within a reasonable period.
- Refunds will be processed using the same payment method You used to place Your order.
- If we reschedule a paid Event, You may choose to attend the new date or request a refund. If it is Your preference to receive a refund, You must let Us know not less than 72 hours prior to the rescheduled Event date.
- We will notify You of any changes as soon as practicable Using the contact details provided at checkout.
- We are not responsible for any additional costs You may incur (e.g. travel or accommodation expenses) as a result of a cancellation or rescheduling.
Guest Speakers
- We don’t endorse, support, or guarantee the views, opinions, or statements expressed by any Guest Speaker participating in this Event.
- The information, advice, or opinions provided by Guest Speakers are their own and do not necessarily reflect those of the Cat Protection Society.
- We make no representation or warranty as to the accuracy, completeness, or reliability of any information or advice provided by Guest Speakers during the Event. Attendees are solely responsible for evaluating and relying on any such information or advice.
- To the fullest extent permitted by law, we disclaim all liability for any loss, damage, or claim arising from or in connection with reliance on any statements, advice, or information provided by Guest Speakers at the Event.
Food and Beverage
- We will provide light refreshments at the Event. If You would like to purchase additional food and beverage, You can do so at the Venue.
- Any additional food and drinks, including alcoholic beverages, may be available for purchase directly from the Venue. We are not responsible for, and accept no liability in relation to, any food or drink (including alcohol) purchased from the Venue or any third party. All such purchases are solely between You and the Venue or third-party provider.
Recordings
- By purchasing a ticket to Our Event You acknowledge and agree that:
- the Cat Protection Society and or Our Guest Speaker may film, photograph or otherwise record Your image, likeness, voice and participating during Our Event, whether in still, video or audio;
- You grant Us and Our Guest Speaker a perpetual, irrevocable, worldwide, royalty-free, and transferable licence to Use, reproduce, publish, adapt, modify, distribute, display, and communicate any images, recordings, or other materials capturing Your image, likeness, or voice, in any media or format, for any purpose, including but not limited to promotional, marketing, commercial, or educational purposes, without further notice or compensation to You; and
- As far as the law allows, You agree that We and any Guest Speaker, and their staff or representatives are not responsible for any claims or complaints about the use of Your image, likeness, or voice.
- You may take photographs or videos at the Event for Your own personal Use only. You must not use any images or videos for commercial purposes without Our prior written permission.
- Where you are purchasing a ticket on behalf of a person aged less than 18 years old, you give consent for Us and the Guest Speaker to film, photograph or otherwise record that individual in accordance with this clause.
- This clause survives termination of this agreement.
Intellectual Property
- All Intellectual Property Rights associated with the content of the Event, including but not limited to presentations, recordings, materials, and other works presented or provided by speakers, shall remain the property of the respective speakers or rights holders (such as the Cat Protection Society or the Guest Speaker).
- Attendees are expressly prohibited from recording, reproducing, or distributing any part of the Event or its associated materials for commercial purposes without prior written consent from the respective rights holders.
- In addition to any other rights that we have at law, and to the maximum extent permitted by law, You agree to indemnify Us on a full indemnity basis for any breach of this clause, save to the extent that we contributed to the breach, including for any costs we incur in seeking legal advice on the breach and in taking legal proceedings against You.
- This clause survives termination of this agreement.
Limitation of Liability
- Nothing in this agreement limits your rights or our obligations under the ACL; however, we exclude all other warranties and liability to you, to the maximum extent permissible by law.
- This clause survives termination of this agreement.
Dispute Resolution
- If a dispute arises in connection with this agreement, both parties agree not to start Court or tribunal proceedings (except for urgent relief) until they have followed these steps:
- The party with the issue must give written notice to the other party, clearly explaining the issue, the outcome they want, and the action they believe is needed to resolve it.
- After receiving the notice, both parties will try in good faith to resolve the issue together within 20 business days. Any communications during this process are confidential and ‘without prejudice’, meaning they cannot be used as evidence in Court.
- If the issue is not resolved, both parties will try to agree on an independent mediator within 7 business days.
- If they cannot agree on a mediator, they will ask the President of the Law Society in NSW to appoint one.
- Mediation will be held virtually if possible, or otherwise in NSW, and both parties will share the costs equally.
- This clause survives termination of this agreement.
Termination
- In addition to any rights at general law, this agreement may be terminated as set out in this clause.
- This agreement may be terminated at any time by either party for any reason. If this agreement is terminated by Us, we will refund You the purchase price, excluding third-party fees and charges which are not retained by Us. If You terminate this agreement, You will not be entitled to a refund other than in accordance with Our obligations under the ACL.
- The termination of this agreement will not affect any rights or obligations of the parties that have accrued prior to the date of termination.
General
- Time is of the essence in this agreement. No extension or variation of this agreement will operate as a waiver of this provision.
- All implied warranties (except for any statutory warranties which we cannot exclude) and conditions are expressly excluded to the fullest extent permitted by law.
- If anything in this agreement is unenforceable, illegal or void, it is severed, and the rest of the agreement remains in force.
- No rule of construction applies to the disadvantage of a party because that party was responsible for the preparation of this Agreement or any party of it.
- Any waiver by any party to a breach of this agreement will not be deemed to be a waiver of a subsequent breach of the same or of a different kind.
- A notice or other communication to a party must be in writing and delivered to that party in one of the following ways:
- delivered personally; or
- posted to their address, when it will be treated as having been received on the second business day after posting; or
- sent by email to their email address, when it will be treated as received when it enters the recipient’s information system.
- Headings are just for convenience, not for interpretation.
- Dates and times set out in this agreement are in reference to Sydney, NSW, Australia.
- Clauses relating to confidentiality, intellectual property, limitation of liability, warranties and any other clauses which by their nature should survive termination, will survive the termination of this agreement.
- The law of NSW governs this agreement, and the parties submit to the non-exclusive jurisdiction of the Courts of NSW.
Definitions
- Australian Consumer Law (ACL) means: Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- Guest Speaker means: Susannah Fullerton.
- Intellectual Property means: any works or materials to which Intellectual Property Rights attach.
- Intellectual Property Rights means: means all Intellectual Property Rights of any kind, in any jurisdiction, subsisting now or in the future (including, without limitation, business, company or trade names, domain names, patents, inventions, copyright, design rights, know-how, trade marks, the right to sue for passing off and rights to Use, and protect the confidentiality of, Confidential Information), whether registered or unregistered, and including the rights to apply for or renew the registration of any such rights and any rights the subject of any lapsed application or registration, as well as all digital and electronic rights.
